Dept all out against errant employers

KUCHING: The State Labour Department has discovered that there are employers who are still not paying their employees according to the new minimum wage scheme.

Its director Awang Raduan Awang Omar said this was proven by yesterday’s statewide “Ops Pendidikan” which uncovered 15 such cases.

He said the operation checked on private education institutions like preschools, driving schools and tuition centres.

Awang Raduan said a total of 73 workplaces were inspected during the operation where 184 cases of violations were detected, 15 of which involved employers who did not pay the minimum wage.

Other violations included employer’s failure to provide and keep a list of terms and conditions of employment (33), failure of employer to prepare and keep employee’s personal register (30), failure of employer to prepare and keep payrolls and allowances (22), failure of the employer to give notice of the commencement of the business (17), failure of employer to pay wages to workers (13), failure of employer to give annual leave to their employees (7), failure of employer to pay overtime pay to employees (6), paying salaries through banks without written permission from employees (6), failing to provide sick leave or paid sick leave (5) and failing to make salary deductions other than allowable deductions (5).

He said a total of 49 notifications of infringement was issued to the employers for corrective actions.

“If the employers fail to do corrective actions, legal action will be taken against the them,” he said, adding that the Sarawak Labour Department would continue to conduct special operations in places of employment in other sectors to ensure compliance with the labour laws and to ensure the rights of workers under the laws are protected.

Malaysia’s standardised minimum wage effective January 2019 is RM1,050 a month, or RM5.05 an hour.
