Girl, 20, fined RM1,000 for disposing of stolen item

KUCHING: A local girl was sentenced to a fine of RM1,000 or two months’ imprisonment by the Magistrate’s Court here yesterday, after pleading guilty to disposing of the stolen property of an iPhone by selling it on Facebook.

Magistrate Zaiton Anuar sentenced the 20-year-old offender after hearing a social report from the Malaysian Welfare Department yesterday.

She was charged with deliberately disposing of stolen goods, namely a smartphone belonging to a 26-year-old woman, according to the accusations.

She committed the crime approximately at 11.30 am on September 1, 2021, at a telecoms shop in the Wisma Saberkas building.

As a result, the accused was charged with disposing of stolen item under Section 414 of the Penal Code which entails a prison sentence of up to seven years or a fine, or both, if convicted.

According to the facts of the case, the victim discovered that her smartphone had been taken and sold on the social networking site Facebook under the name ‘Ian Wenceskaus’ by one of her former employees.

The victim then took the smartphone’s Imei number to the store where the accused sold it to confirm that it was hers. He loss was believed to be roughly RM2,000.

She then filed a police report in order for additional action and inquiry to take place.

Investigations revealed that the accused had disposed of stolen goods in the form of a smartphone and sold it at a phone shop, and he (the suspect) was also aware that the phone in issue was stolen.

The case was prosecuted by Prosecuting Officer Inspector Merylene Lindan Andrew Mang, and the accused was not represented by a lawyer.
