Jobless man fined RM1k for committing mischief

KUCHING: A 36-year old unemployed man was fined RM1,000 by the Magistrates’ Court after the man punctured a tyre and broke a windscreen wiper of his elderly neighbour’s car.

The accused, Jesfrel, 36, pleaded guilty to a charge read by an interpreter before Magistrate Zaiton Anuar.

The accused was charged with mischief under Section 427 of the Penal Code for deliberately breaking a windscreen wiper and punctured an MPV car tyre which belonged to his 64-year old elderly neighbour.

The Section provides imprisonment of up to five years, a fine, or both, upon conviction.

The accused committed the offence at a house in Jalan Batu Kawa at 6.58 pm on Feb 7, 2023.

According to the facts of the case, the owner of the car checked the closed circuit television (CCTV) camera footage on February 8 at 5 pm that his car tyre had been punctured and a windscreen wiper had been broken.

The CCTV footage showed his neighbour, known as Bob, committed the offence and the incident had cost the elderly 64-year-old man around RM500 to repair.

The victim lodged a police report which led to the arrest of the accused the following day on February 9.

It is understood that the accused committed the offence because he does not like his 64-year-old neighbour.

The case was prosecuted by Insp Merylene Lindan Andrew Mang, while the accused was unrepresented by a legal counsel.
