Jobless slapped with RM3,500 fine for threatening, damaging car

KUCHING: A jobless man was fined RM3,500 by the Magistrate’s Court here for threatening to kill and damaging his friend’s car in October last year.

The accused, Bahthiar, 31, from Kampung Sungai Maong, pleaded guilty to two charges before Magistrate Syarifah Fatimah Azura Wan Ali.

According to the first charge, he was prosecuted under Section 506 of the Penal Code for threatening to kill the 30-year-old victim during an argument.

Meanwhile, for the second charge, Bahthiar was charged under Section 427 of the Penal Code for intentionally damaging the front and rear windows of a car belonging to the same victim, causing losses amounting to RM400.

The accused committed the act in a house at Kampung Sungai Maong around 1am on Oct 5, 2022.

Syarifah imposed a RM1,500 fine in default of two months in jail for the first charge. As for the second charge, the accused was fined RM2,000 in default of three months in jail.

Based on the facts of the case, on Oct 4, 2022, around 10 am, the complainant (victim) and the accused used a car to go to an aquatic pet store.

As soon as they arrived, the accused went in and immediately took four live chickens into the car without paying.

The accused was told to return the chickens but refused to do so.

After that, the complainant found that the shop owner had viralled the complainant’s car and accused the complainant of stealing chicken from his shop on a Facebook page named ‘Manok Local Sarawak’.

The accused, who got furious and he was often contacted by the complainant to return the chickens, went to the complainant’s house and damaged the car windows and threatened the complainant.

As a result, the complainant lodged a police report for further action, which led to the arrest of the accused at a restaurant in Batu Kawa around 4.40pm on Nov 21, 2022.

Insp Mohd Adzmei Ahmad who prosecuted the case, requested that the accused be given heavy punishment as a lesson.
