Labourer charged with incest with sister-in-law goes free

KUCHING: The Session’s Court here on Friday (Sept 17) discharged and acquitted a labourer who was charged with two counts of incest with his sister-in-law three years ago.

Judge Jason Juga ruled that the prosecution had failed to prove a prima facie case against the 23-year-old accused.

According to the first charge, the accused committed incest with his then 14-year-old sister-in-law at a factory hostel in Dec 2018.

The accused was also charged with repeating the same act at a hotel around 11.30am on April 2, 2019.

The charges were framed under Section 376B (1) of the Penal Code which carries a jail term up to 30 years and whipping, if convicted.

Deputy public prosecutor Nurfadzlin Mahmad Zulhasnan prosecuted while the accused was represented by counsel Steven Beti and Gerald Donald.
