Man gets 10 months for possessing clozapine

KUCHING: The Sessions Court here sentenced an unemployed man to 10 months in prison for possessing 16.43g of the anti-psychotic drug clozapine, a scheduled poison, in his bedroom in June last year.

Abbas, 23, pleaded guilty before Judge Afidah Abdul Rahman to a charge framed under Section 9(3) of the Poisons Act 1952, punishable under Section 32 (2) of the same Act.

If convicted, he can be fined up to RM3,000 or sentenced to prison for a term of up to one year or both.

He was charged with possessing the substance in a bedroom of a house in Jalan Muhibbah around 12.45pm on June 9 last year.

Judge Afidah ordered the accused to serve his sentence effective from Wednesday (May 3)

According to the facts of the case, police raided the house and arrested Abbas on suspicion of substance abuse.

A search led to the discovery of a black bag hidden behind a wall clock. The bag contained eight strips of drugs believed to be Erimin 5.

The substance was taken to the Chemistry Department for analysis and the report confirmed that the substance was clozapine, which is a substance listed under the First Schedule of the Poisons Act 1952.

Deputy public prosecutor Iezzah Iburdanisha Ibrahim prosecuted the case while the accused was unrepresented by legal counsel.

The accused previously served a five-year prison sentence for an offence under Section 39C of the Dangerous Drugs Act 1952 for drug abuse.
