Foreigners jailed 6 months for having stolen bikes

KUCHING: Two Indonesian men were each sentenced to six months in jail by the Magistrate’s Court here, for possessing two stolen motorcycles in a palm oil plantation in Lundu, last December.

The accused Daniel, 31, and Amirudin, 27, both from West Kalimantan, Indonesia, pleaded guilty before Magistrate Zaiton Anuar to a charge framed under Section 411 of the Penal Code.

The section carries a jail term of up to five years and a fine, upon conviction.

According to the charges, Daniel was accused of possessing a stolen Yamaha motorcycle belonging to a 20-year-old man.

Meanwhile, Amirudin was accused of possessing a stolen Honda motorcycle belonging to a 33-year-old woman.

They committed the offence at Jalan Ladang Sawit Kampung Raso, Lundu around 10.20 am on Dec 13 last year.

According to the facts of the case, two police reports regarding the loss of motorcycles were lodged by the victims on Dec 9 and Dec 11 last year.

On Dec 9, at about 7 am, the male victim reported that his locked and parked motorcycle in front of a shop in Batu Kawa, was lost and was believed to have been stolen.

Whereas, on Dec 11, around 8.50 am, the female victim reported that her Honda motorcycle had gone missing after it was parked in front of the Wisma Hyfa, Jalan Samarak.

The next two days on Dec 13, the police patrolling the Malaysian-Indonesian border, came across two men in a suspicious condition, each riding a motorcycle without a registration number.

When approached, the two accused attempted to flee the scene but they were promptly caught by the authorities.

Investigation found that the two accused were having the two stolen motorcycles belonging to the victims after authorities confirmed that the respective engine chassis numbers were the same as reported.

Inspector Merylene Lindan Andrew Mang prosecuted while the two accused were unrepresented by any counsel.
