Ministry seizes hair products using trademark illegally

KPDN Bintulu enforcement officers confiscating the counterfeit pomade hair oil products at one of the supermarkets in Bintulu on Tuesday.

BINTULU: Suspect hair styling products were seized in a series of raids on four supermarkets in town on Tuesday (Apr 11).

Ministry of Domestic Trade and Cost of Living (KPDN) Bintulu branch chief Al Redzamani Abdul Razak said a total of 435 pomade hair oil products worth RM3,000, were seized.

“The raids on the premises were carried out together with representatives of the trademark owner of the products.

“The products were suspected of using the trademark illegally,” he said.

To date, six cases have been recorded under the Trademarks Act 2019 here this year.

He stated that the cases are being investigated under Section 102 (1)(c) of the Trademarks Act 2019, which is to have in control for trading purposes a registered trademark that is used incorrectly under Section 100 of the same Act.

“If convicted, corporations can be fined up to RM15,000 for each item used with the wrongly registered trademark.

“For the second or subsequent offences, they can be fined up to RM30,000 for each item used with the wrongly registered trademark.

“As for individuals, they can be fined up to RM10,000 for each item used with the wrong registered trademark or sentenced to jail for a term of up to three years or both,” he said.

KPDN Bintulu, he said, will continue to intensify intellectual property law enforcement activities in accordance with the Trademarks Act 2019, the Trade Description Act 2011 and the Copyright Act 1987.

Al Redzamani said the operation was aimed at combating the sale of such goods with the cooperation of trademark owners in the country.

In the meantime, he advised the public to be more careful in making online transactions, especially involving branded goods.
