Three men fined RM3,000 for assault that went viral on social media

KUCHING: Three men were each fined RM3,000, in default five months in prison, by the Magistrates’ Court here on Wednesday (Oct 11) for intentionally causing injury to a male victim using a PVC pipe in an incident that went viral on social media in August.

Magistrate Syarifah Fatimah Azura Wan Ali handed down the sentences to Lai Peng Ann, 59 (first accused), Fu Ted Siong, 25 (second accused), and Alex Lai Hong En, 23 (fourth accused), each of whom pleaded guilty to charges under Section 324 of the Penal Code, read together with Section 34 of the same code.

According to the charges, they collectively caused injury to a 26-year-old male victim intentionally using a PVC pipe. They committed this offence in front of a store in Jalan Stephen Yong, at around 11pm on Aug 29.

If found guilty, they could face a maximum of 10 years in prison or a fine or caning, or any combination thereof.

Meanwhile, the third accused, who also pleaded guilty, a 19-year-old juvenile offender, was released on bail of RM2,000 while awaiting a social report.

The court set the social report for the third accused on Nov 15.

According to the facts of the case, during the incident, in front of a store, the victim was approached by an unknown group of men who proceeded to beat him using a PVC pipe and a baseball bat. Additionally, they aimed a shotgun at the complainant.

The incident stemmed from the accusation that the complainant had broken into and stolen iron from a store behind the said store. However, the complainant’s actual intent was to meet a female worker to discuss a job offer.

As a result of the incident, the complainant suffered injuries throughout his body and subsequently filed a police report for further action and investigation.

The investigation results, based on evidence and the victim’s statement, indicated that all the accused deliberately caused injury to the victim using a black PVC pipe as a weapon.

The prosecution of the case was conducted by Inspector Mohd Adzmei Ahmad while the accused were not represented by lawyers.
