KUCHING: Two apartment buyers were awarded a total sum of RM23,890.16 by the Sarawak House Buyers Claim Tribunal Court for the delay in the delivery of their property by their developer. In the first case, apartment buyer, Ngui Fui Heng was awarded RM17,956.08 for a 136-day delay in the delivery of his property, an apartment costing RM481,913.00 at Jalan Wan Alwi here by the developer. The delay was 256 days starting from August 12, 2016 until April 28, 2017 when the OP was issued. 120 days were deducted from the 256 days because the 120-day delay was caused by the requirement of the authority and it was not the fault of the vendor. The RM17,956.08 award was for the delay of 136 days multiplied by RM132.03 everyday. In the second case, Tan Hong Choo, was awarded RM5,934.08 for the delay of 38 days i n the delivery of ownership of her apartment costing RM570.000.00 at Jalan Wan Alwi here by the same developer. The delay of 120 days was by the authorities so she was given only 38 days; RM156.16 per day multiplied by 38 days amounted to RM5,934.08. The common facilities were due for completion on December 23, 2016, and the CPC was issued on October 13, 2016 so there was no delay. Meanwhile, in the case of property buyer, Chin Ying Ying who claimed for delay in completion of the common facility at her two apartment units costing RM526,000.00 each at Jalan Wan Alwi, Kuching, the Sarawak House Buyers Claim Tribunal Court yesterday decided to make its ruling on the cases later as it had to review the facts because of the wrong date. The Tribunal’s decision was that the car park, which was part of the building, was a common facility. The Tribunal yesterday was presided by its president, Dato Hajjah Maznah Binti Dasmi and assisted by two panel members, Peter Lim Thiam Seng and Robert Elone Sireng. Payments must be made within 45 days after the issuance of the Tribunal Award Letters.
