Youth gets RM3k fine for mischief

SIBU: The Magistrate’s Court here yesterday fined a youth RM3,000, in default of three months’ jail for committing mischief.

Magistrate Oon Kork Chern imposed the fine on Dave Wong Yan Dao after he pleaded guilty to the offence.

Wong, 20, from Upper Lanang was charged with wrongful loss namely causing destruction of the mobile phone belonging to a 53-year-old woman thereby committing mischief under section 425 of the Penal Code. This occurred at a house in Upper Lanang on Jan 5 at about noon.

Punishable under Section 426 of the Penal Code (punishment for mischief), the offence provides for a jail term which may extend to five years or fine or both upon conviction.

In outlining the fact of case, Prosecuting Officer ASP Linggi Tawi told the court that investigation for the case revealed that on Jan 5 at about noon, the complainant had an argument with the accused at a house in Upper Lanang.

It was further revealed that the accused had gripped strongly the mobile phone used by the complainant.

As a result, the mobile phone was destroyed due to the accused’s action towards the complainant.

The argument took place because the accused could not withstand the complainant’s nagging.

Hence, the accused had committed an offence of mischief punishable under Section 426 of the Penal Code.
