Tribunal orders developer to pay purchaser RM9,560

KUCHING: The Sarawak Housing Purchaser Claims Tribunal has ordered a developer to pay a total of RM9,560 in damages to the purchaser of two units of double storey corner terrace house in Salak Land District and Matang Land District.

Its president Dato Hajjah Maznah Dasmi also ordered the developer to ensure that all building specifications and inspection to be done under the monitor of the tribunal.

“We have four cases today and two of them are involved in a delay of between 16 months 15 days and 13 months 15 days in handover of the houses,” she said during a press conference after the tribunal proceeding at the tribunal court in Old DUN building, yesterday.

“On the first case, the house still has not been handed over and they don’t know why the water supply cannot be installed.

“The developer has to pay him RM4,160, for the remaining of RM6,600 for a delay of 16 months and 15 days, whereby, the purchaser has received RM2,440. There are also defects found in the house, meaning the house is still not completed yet,

“Joint inspection from engineers from the ministry will identify the quality needed to fix the defect and it is to be based on our standard,
“After being approved by the engineers, then the developer has to fix it and decide the date it will be done. After two weeks of completion, the developer needs to pay the contractor and all the process will be monitored by the tribunal,” she said.

On second case, there is also a delayed handover of the house whereby the developer has to pay her RM5,400 for a delay of 13 months and 15 days.

“The developer explained that it was due to the slow drainage construction works by Drainage and Irrigation Department (DID). However, the developer should inform it with the authorities and it was under their responsibilities.

“There is also a defect found in the house and the inspection process is similar with the first case which is also monitored under the tribunal,” she explained.

Meanwhile, for the third and fourth case is the similar case whereby the purchasers complain about the size of staircase being not done accordingly to the blueprint size.

“The developer has agreed to work together with our engineer to address the staircase issue.

“Regarding the misrepresentation of the house, whereby the salesman and accountant of the company are offering the rebate of RM5,000, the tribunal has decided to ask the developer to check the information and take a proper action on that,” she said.
