Online gambling lands Indonesian with RM10K fine

KUCHING: An Indonesian teenager was fined RM10,000 in default of one month’s  jail by the Magistrate’s Court here for engaging in an online gambling activity.

Magistrate Syarifah Fatimah Azura Wan Ali sentenced the 16-year-old accused from Bengkayang, Indonesia yesterday (Nov 17).

The court also ordered the accused to be referred to the Malaysian Immigration Department for further action.

According to the charge sheet, he committed the offence by using a smartphone at a house in Kampung Panglima Seman here around 9.20pm on Nov 6.

The accused was charged under Section 4B (a) of the Common Gaming House Act 1953, which provides for a maximum fine of RM10,000 for each gambling machine and a jail term up to five years, upon conviction.

Based on the facts of the case, a police team raided the house in Kampung Panglima Seman after suspecting that the occupant was carrying out online gambling activities via an application in a smartphone.

Police investigation and gambling expert’s report confirmed that the seized phone belonging to the accused, was used as a gambling machine, as stated under the interpretation of the Common Gaming House Act 1953.

Also seized were cash amounting to RM110 and a piece of paper with passwords and usernames written on it for online gambling.

Insp Mohd Adzmei Ahmad prosecuted the case while the accused was unrepresented.
