NATIVE Customary Rights (NCR) lands located in Licenced Planted Forests cannot be developed by the LPF holders.

Assistant Minister of Urban Development and Resources Datuk Len Talif Salleh in clarifying this, said this has been enshrined in the terms and conditions of LPF where NCR lands will be distinguished from LPF should the two overlap.

“According to the terms and conditions, if the lands have been surveyed (as NCR lands), it will automatically disqualify LPF holders from developing the respective lands.

“Even though the (NCR land) is physically inside the LPF, in terms of operations, LPF holders have no rights in the NCR land,” he told a press conference.

He also said there have been sentiments on the ground expressing concerns over properties located in LPF areas.

“The fact is that even though their houses are located in LPF areas, LPF holders have no rights over NCR lands.

“All LPF areas that have been surveyed under NCR lands, houses as well as longhouses … they have been separated (from LPF) according to the terms and conditions,” he reiterated.

As for NCR land claimants in LPF areas, Len Talif said applications for perimeter surveys may be submitted to the Land and Survey Department.

“The application for NCR land surveys is subject to certain processes where claimants must inform the Land and Survey Department to investigate the status.

“For areas with NCR claims inside LPF areas, should it be valid, can be applied through the Land and Survey Department for a perimeter survey,” he added
