Two fined for keeping stolen item

KUCHING: Two friends’ joy of owning an ultrasound scanning machine (medical) was short-lived, when they were found guilty of possessing the item as it was a stolen property. 

In the Magistrate’s Court here today, each was fined RM1,500 for having in their possession a stolen property an offence under Section 411 of the Penal Code. Each has to serve one month in jail for any failure to pay the fine.

Magistrate Zubaidah Sharkawi passed sentences on the Accused, Jonathan, 26, and Beatrice, 21, after pleading guilty to the charges read together before them.

According to the charges, they jointly owned the stolen property of an ultrasound scanner machine belonging to a 46-year-old man.

They were found owning the stolen property at a cafe on Jalan Saradise, here, at about 1.30 pm on March 23.

Thus, both of them were charged under Section 411 of the Penal Code and read together with Section 34 of the same Code which provides for imprisonment for up to five years or a fine or both, if convicted.

According to the facts of the case, the complainant got a message through the WhatApps app from a man named Jonathan who offered an ultrasound scanning machine to the complainant.

The complainant asked for the reference number of the machine and then found that the reference number of the machine was the same as the machine ordered and was found missing during the delivery process by the courier.

Estimated losses incurred by the complainant was about RM100,000.

The complainant then lodged a police report for action and further investigation which in turn led to the arrest of the two accused.

Prosecution of the case was handled by Prosecuting Officer ASP Rogayah Rosli while the two accused were represented by lawyer Lim Lian Kee.
