Inspect house before handover

KUCHING: Prior to accepting the keys to their new homes, purchasers should have a joint inspection with the developer and come up with a list of defects to be signed off by both parties, advised members of the Sarawak Housing Purchaser Claims Tribunal (TTPRS).

TTPRS deputy chairman Peter Lim Thiam Seng as well as TTPRS members Robert Elone Sireng and Simon Woon Ta Meng shared their advice during a press conference following a tribunal proceeding yesterday whereby two cases regarding late delivery and housing defects were heard.

“Once there is a defect list that both parties have agreed upon, as the developer rectifies the defects, they should be ticked off the list,” said Woon during the press conference at the Old State Legislative Assembly Complex here. Extending words of advice to developers as well, Lim urged them to be careful when signing the Sales and Purchase agreement with purchasers.

“At the end of the day, they will be subject to a penalty of a certain payment if delivery is late,” he elaborated. Lim also advised developers to be sincere in dealings. “They should try to do the best that they can for the house buyers. In developing and selling buildings, developers should ensure that they are properly done,” he said.

Elone recommended that buyers should be mindful when it came to payments and agreement terms. “Even if house buyers accept payments from the developer and an indemnity letter is signed saying that they will not make further claims, we still have cases where people do make further claims,” he remarked.

He advised buyers to accept what is offered by the developer in good faith, and likewise developers should fulfil payments honestly as well.
